The act of placing an order implies full and entire acceptance of these General conditions of sale, which may be accessed at anytime on the site, especially when registering the order.


They form the sole agreement between the parties and prevail over any other document. They may be modified at any time. The new general conditions of sale will apply to any order placed after they have been postedon the site.
Orders placed on the site are for private individuals and companies who are "final buyers" other than for their resale. The resale of FELIX BOPP products is strictly forbidden by those who plan to sell as abusiness activity.

1. The items on sale
Cutomized items are designed and manufactured to your specifications within the sole limits of the choices offered.

2. The unit prices of the items and the total amountof the order
Prices are displayd include and axclude VAT, indicated in currency you selected.
Prices may be changed at any time, it being understood that the items are invoiced on the basis of the price in force at the time of placing your order
The prices of the items do not include costs (shippingcosts, customs duties). Customs duties or other local taxes may have to be paid on delivery to countries other than Germany. These duties are calculated when the order is placed and are payable with the order.

3. The order and confirmation of the transaction
When ordering, you will need to follow a procedure of customization. After customization go to the "Recap" screen, which allows you to add the article to your "Shopping cart". Once you have confirmed the contents of the "Shopping cart" screen, you may begin the order process.

STEP 1, SIGN IN:  Createyour account or identify yourself.
STEP 2, ADDRESSES:  Enter your billing and shipping addresses, so that parcels can be delivered to the correct address as quickly as possible.
STEP 3, PAYMENT:  Enter your payment details
STEP4, ORDER CONFIRMATION:  Access the "Order confirmation" stage. At the same time, you will receive an email confirming your order, and this will act as an order form.
When your purchase has been shipped, you will receive a shipment confirmation by e-mail.


4. Payment
Payment of your purchases is by credit card or PayPal, when you place the order.
You may make your purchases in complete safety. The bank details that you transmit on line to a registered bank are confidential and carried out in a secured environment (SSL protocol). Payment card numbers are not conserved on our site, but on a banking establishment’s secure site.


5. Reserve of ownership
We remain the owners of the items sold until the complete payment of the price.


6. Delivery and Reception
A guideline delivery date is shown on your order review. In all cases, your article(s) will be delivered to the address shown on your order or to your private customer manager. Items are delivered by an independent carrier. They are insured by us until they are delivered. Similarly, items may not be delivered to a delivery address equivalent to a post box. Shipping costs are indicated in the "Order review".


Precautions:
To avoid any complications regarding the receipt of your parcel, please read the following information carefully:


- The carrier may deliver the package to the receiver named on the waybill or to any other person appearing to have authority to accept delivery of the shipment on the receiver's behalf (such as persons at the same premises as the receiver or neighbours of the receiver).


- If you receive a note saying that the carrier called to deliver, contact them immediately to arrange a new delivery date. If you do not accept delivery of the parcel, the carrier may return it to us.


Parcel damaged during transport:
If you see that your parcel or article has been damaged, please contact the customer service at: shop@felixbopp.com giving details of the damage observed (parcel damp, holed, open, etc.), as we need to send a registered letter to the carrier.

7. No right of withdrawal (U.S.)
 Considering the unique and customised nature of the article, the latter may not be returned or exchanged, in accordance with article L. 121-20-2 of the consumer code:
"The right of withdrawal may not be exercised, unless the parties agree otherwise, in contracts: (...) 3° For the supply of goods manufactured to the consumer's specifications or clearly customised...".
As a result, you have no option to claim any right of withdrawal. We therefore recommend that you give the time and attention required for designing your article.

8.Visible defects - Non-compliance
Visible defects:
You should check the condition of the delivered article. If you find a visible defect, you have 7 days from the date of delivery in which to make a complaint to the E-shopping customer service at shop@felixbopp.com. Once your complaint has been validated, your contact will send you a "Return Form" which must be attached to your returned parcel.


Once the 7-day period has elapsed, the article will be deemed to be free of any visible defects. Our Custom bags workshop has the sole authority to judge the validity of the return.


Non-compliance:
If you note that the delivered article does not match your order confirmation, please contact the E-shopping customer service at us at shop@felixbopp.com.Once your complaint has been validated, your contact will send you a "Return Form" which must be attached to your returned parcel.

Payment of return costs and the means of shipment that you must use:
In the event of a visible defect or proven non-compliance, we will pay the return costs of the article. Please make sure that you return your article in its original condition, with its packaging, via a carrier that allows you to monitor your shipment.


Please note that items returned incomplete, ruined, damaged or soiled will not be taken back.
Please note also that the refund will only be made to the person who initially paid for the article online.


9. Guarantees - After-sales service

9.1 Legal guarantees
The ordered items are covered by a legal guarantee of compliance and by a guarantee against hidden defects.
You have a period of 2 years in which to invoke the above guarantees by contacting FELIX BOPP after-sales department. This period runs from the delivery of the items for the legal obligation of compliance and from the discovery of the defect for the hidden defects of your country.

9.2 FELIX BOPP guarantee
The items on sale comply with the German regulations in force. They benefit from FELIX BOPP expertise and quality.
They are thus guaranteed against any manufacturing faults. If such a fault occurs, FELIX BOPP will repair your purchase free of charge, or exchange it. Exchanged items will not be returned.
The FELIX BOPP guarantee obviously does not cover normal wear and tear, accidental damage or damage caused by the use of a solvent or by the abnormal use of the article.
Damage caused during air transport should be reported immediately to the airline concerned, which will take responsibility for the claim.

9.3 FELIX BOPP After-sales Service
FELIX BOPP After-sales Service is responsible for repairs covered by Legal Guarantees and the FELIX BOPP guarantee, and for any wear-and-tear repairs to your items.
Your article will be sent to our workshops, where an appropriate decision will be taken:
- free repair or replacement by a new article of an equivalent value for items that contain a manufacturing defect that has been observed and validated by our workshops.
- repair (charged) for worn items. We will offer you an estimate on the costs.
- no repair and return of the article if it is too worn-out.


10. Liability
We are not liable:
- for a possible difference in color between "the screen and reality".
- for the wording of the personal message accompanying your gift and any consequences thereof.
- for the customization choices made on the article that are not suitable, even if it is a gift.
Furthermore, we may not be considered liable or deficient with regard to any delay or non-fulfillment arising out of the occurrence of a case of "force majeure".
Finally, please note that we may not be held liable for any order placed by a minor whose parents may or may not have authorized the order.


11. Document conservation
For all orders over 150 USD, we undertake to keep the documents relating to the transaction for a period of 10 consecutive years. We guarantee your access to them at any time, on simple request.


12. Computers and Individual Liberties
Your personal information is necessary in order to process your order, and at no time will this information be sold, marketed or rented to third parties.
You have the right to access, modify, correct and oppose any information concerning you (shop@felixbopp.com).


13. Applicable law, disputes
These conditions, the order and all actions that arise out of them are governed by German law. In the event of a dispute, and if this cannot be settled amicably, the German courts have sole jurisdiction.
